1) Acceptance of Terms
These Terms of Service (the “Terms”) form a binding agreement between you and Predixy (“Company”, “we”, “us”, or “our”). By accessing or using our websites, APIs, or software (the “Service”), you agree to these Terms. If you are using the Service on behalf of an entity, you represent that you have authority to bind that entity and “you” includes that entity.
2) Service Scope and Beta Status
- The Service focuses on analyzing publicly available web pages to surface experiment patterns (e.g., A/B tests, personalizations) based on signals such as visible page differences, public scripts, and network indicators.
- We do not require nor intentionally process non‑public information, paywalled content, or data obtained through circumvention of technical access controls.
- During BETA, features, accuracy, performance, and availability may vary. We may throttle, suspend, modify, or discontinue the Service at any time.
3) Eligibility and Accounts
- You must be at least 18 years old and capable of forming a binding contract.
- You are responsible for your account credentials, for all activity under your account, and for keeping your information accurate and up to date.
4) Acceptable Use; Customer Responsibilities
- Use the Service only in compliance with applicable law, including intellectual property, computer misuse, and privacy laws in your jurisdiction.
- Do not: (a) attempt to access non‑public areas; (b) bypass robots.txt or technical access controls; (c) interfere with site operations; (d) submit or request processing of any data you do not have lawful rights to process.
- You are solely responsible for configuring your scans to target only publicly available resources and for your own compliance obligations (e.g., website terms of use for targets you analyze).
5) Intellectual Property
- We retain all rights, title, and interest in the Service and our content, including software, documentation, and branding. No license is granted except as expressly set out in these Terms.
- You retain rights in your content that you submit to us. You grant us a non‑exclusive license to use that content solely to provide the Service and to improve the Service in de‑identified/aggregated form.
6) Privacy; Public‑Data Emphasis
- Our Privacy Policy explains how we collect and use information. By using the Service, you consent to those practices.
- We design the Service to operate on public data. You agree not to submit non‑public, confidential, or sensitive personal information. Where such information is inadvertently processed, you must notify us promptly at privacy@predixy.ai.
7) Regional Compliance Disclosures (California & India)
We aim to align the Service with key regional requirements. Please also review the Privacy Policy for detailed disclosures.
- California (CCPA/CPRA): We do not “sell” or “share” personal information as those terms are defined, and we restrict use of any personal information for our business purposes (e.g., security, debugging, service improvement). California consumers may submit rights requests (access, delete, correct, limit sensitive PI) by contacting privacy@predixy.ai. We will verify requests consistent with law and will not discriminate for exercising rights.
- India (DPDP Act 2023): We act as a Data Fiduciary for any personal data processed. We provide notice, obtain consent where required, and honor requests for access, correction, erasure, and grievance redressal via grievance@predixy.ai. We maintain reasonable security safeguards and support cross‑border transfers consistent with the DPDP and applicable rules.
8) Third‑Party Sites and Content
The Service analyzes third‑party websites. Those sites are not under our control, and their content, policies, and availability are their own. You are responsible for your interactions with such sites and for honoring their terms, robots directives, and applicable laws.
9) Disclaimers; Beta Warranty Disclaimer
- AS IS / AS AVAILABLE: The Service (including BETA features) is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, non‑infringement, accuracy, or reliability.
- We do not guarantee that experiment detections are complete, correct, or timely. You should not rely on outputs as the sole basis for decisions.
10) Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to these Terms or the Service. Our aggregate liability shall not exceed the greater of (a) USD $100 or (b) amounts you paid to us in the 3 months preceding the claim.
11) Indemnification
You will defend, indemnify, and hold harmless the Company and its affiliates from any claims, losses, liabilities, and expenses arising from your use of the Service, your content, or your violation of these Terms or applicable law.
12) Suspension; Termination
We may suspend or terminate your access immediately for breach, security risk, or legal requirement. You may stop using the Service at any time. Sections intended to survive termination will continue in force.
13) Governing Law; Dispute Resolution
- U.S. Users: These Terms are governed by the laws of the State of California, without regard to conflict‑of‑law rules. Any disputes will be resolved in the state or federal courts located in San Francisco County, California, and you consent to their jurisdiction.
- Indian Users: For users located in India, these Terms are governed by the laws of India, and courts in Bengaluru, Karnataka will have exclusive jurisdiction.
- Either party may seek injunctive relief for actual or threatened misuse of IP or confidential information in any court of competent jurisdiction.
14) Updates to These Terms
We may update these Terms from time to time. We will post the updated Terms with a new effective date. Your continued use of the Service after changes become effective constitutes acceptance.
